Florida regulatory framework

Florida DEP is responsible for statewide OSTDS statutes and Chapter 62-6 rules. During the phased program transition, permitting authority depends on county: many counties still use the Florida Department of Health county office, while DEP directly permits selected counties. County health department remains the local permitting office

Florida DEP administers the statewide OSTDS rules, while Lee County remains in the group where the Florida Department of Health county office issues permits and handles inspections. Applicants should file locally with DOH-Lee rather than using the DEP permitting portal used in DEP-administered counties.

New-system application has county-specific design requirements

DOH-Lee requires the construction-permit application, site plan, floor-plan information when applicable, and a site survey. For new OSTDS in unincorporated Lee County, the county office states that the system must be designed by a Florida-licensed professional engineer and the plans must bear the required seal and signature.

Published new-system fees

DOH-Lee lists a $390 new-system application fee and an additional $155 charge when the county must perform a site evaluation. It also lists a $100 additional inspection fee for outer islands accessible only by boat. Verify the current invoice before payment because fee schedules can change.

Repair permits require an existing-system evaluation

For a failing-system repair, DOH-Lee requires a construction-permit application, the Existing System and System Repair Evaluation form, and a site plan showing relevant lot features. The county office currently lists a $350 repair-permit application fee.

Building additions can trigger septic review

DOH-Lee requires existing-system review when a building addition or change of use increases sewage flow, changes sewage characteristics, or otherwise triggers Chapter 62-6 requirements. Limited additions with no bedroom increase and no encroachment can qualify for a simpler review.

Aerobic systems have continuing operating and maintenance duties

DOH-Lee states that aerobic treatment units require an operating permit renewed every two years and a valid maintenance contract for the life of the system. The maintenance entity must inspect or service the ATU at least twice per year, and the county health department performs at least annual oversight inspection of ATU maintenance and performance.
