Texas permitting framework

Texas requires applicants to work with the local permitting authority where an authorized local OSSF program exists. TCEQ notes that local programs can be more stringent than statewide minimums, so county-specific procedures control within the county program’s jurisdiction.

County Environmental Health administers OSSF permitting

Fort Bend County Environmental Health operates the local OSSF program for onsite systems producing no more than 5,000 gallons of waste per day. Its responsibilities include application and design review, pre-construction inspections, new-construction/modification/repair inspections, final approval inspections, complaint investigation, enforcement, and abatement.

Online-only plan review

Fort Bend County states that OSSF plan-review applications are accepted online through its My Health Department portal. Paper plans and USB submittals are not accepted for the plan-review process.

Construction, modification, and repair are inspected

The county expressly lists inspections for new construction, modification, and repair among its OSSF responsibilities. Applicants should therefore obtain county approval before work and keep the system available for the required inspection sequence rather than assuming a repair is exempt.

Aerobic and other maintenance-required systems

After the initial two-year maintenance contract expires, Fort Bend County requires each ATU or other OSSF that requires routine maintenance to submit a renewing maintenance contract and the annual renewal fee. The county also states that contracted aerobic-system maintenance must be performed by a certified maintenance provider unless the owner is personally certified for that treatment unit.
