Texas permitting framework

Texas requires a permit and approved plan to construct, install, alter, extend, or repair an OSSF unless a specific exemption applies. TCEQ directs owners to the local permitting authority where an authorized local program exists and warns that local programs can be more stringent than statewide minimums.

Licensed OSSF professionals

TCEQ licenses or registers site evaluators, installers, maintenance providers, maintenance technicians, and designated representatives. County procedures can require particular licensed professionals based on system type, site conditions, and local rules.

Permit required regardless of acreage

Guadalupe County states that a permit is required for all OSSFs regardless of lot size or acreage. Before building, altering, extending, or operating an OSSF, the owner must have county/TCEQ authorization and ultimately a License to Operate.

Application package includes licensed-professional documentation

Advanced systems require continuing maintenance

Guadalupe County’s homeowner guidance states that advanced OSSFs must be inspected every four months and that a signed maintenance contract between the property owner and maintenance provider is required for advanced systems, subject to the applicable owner-maintenance provisions and current state/county rules.

County review can take up to 30 days

The county brochure states that many applications are approved in about 10 business days, but review can take up to 30 days depending on complexity and application volume. Applicants should not schedule installation on the assumption of immediate approval.

Published permit and repair fees

The county’s published Environmental Health fee schedule lists $400 for a residential conventional OSSF application, $500 for residential advanced treatment, and $600 for multi-unit, rental-community, condominium, or commercial applications. Other OSSF applications such as tank/lid replacement, disposal-system relocation, connection to an existing system, and repairs are listed at $200, with a $200 OSSF reinspection fee. Confirm the current fee schedule before payment.

Licensed installer requirement with a narrow owner exception

Guadalupe County’s homeowner brochure states that an OSSF must be installed by a licensed installer or, for a single-family dwelling, the qualifying property owner under the owner-installation provisions. Owners should confirm eligibility with Environmental Health before relying on that exception.
